Terms and Conditions

This retreat Agreement communicates our mutual expectations during the Rising Sun Healing Retreat, operated by Xu DaRocha Healing Art. Please raise any questions you have before booking to ensure we are on the same page moving forward.

In exchange for being allowed to participate in the Retreat, you agree to be bound to the following terms.

This Agreement is made between Xu DaRocha Healing Art (“we,” “us,” “I,” and “our”) and you or the person who has made a $1000 deposit. Before the trip, you will also sign a physical or electronic copy of the same terms and conditions.

1.  A $1000 deposit is required to reserve your spot on a retreat. The balance of $1750 is due on August 12th,2024, unless you have made other arrangements with Xu DaRocha Healing Art.

2. You are responsible for purchasing airfare to and from Rangiroa. Please make sure you arrive no sooner than Oct 12th, 2024, and you will leave no later than Oct 19th, 2024.

3. You have read the retreat's information page and understand that you will share a room or bungalow with someone else. You are aware that there is no hot water for the shower and no room services, pools, or bars as in hotels.

4. We kindly request that all attendees treat one another respectfully during the retreat. This includes being mindful of our behavior and avoiding any actions that could be disruptive or offensive to others, including the house owner, staff, teachers, and fellow participants. Please keep in mind that loud music, parties, or any other activity that may disturb the peace and tranquility of the retreat is strictly prohibited. Adhering to these guidelines ensures that everyone has a positive and fulfilling experience during this retreat.

5. Refund and cancellation policy:

   100% refund before July 12th. 

   80% refund from July 13th- Aug 12th.

   50% refund from Aug 13th-Sept 12th. 

   No more refunds after Sept 12th.

6. All the content we provide to you during the retreat, including, but not limited to, lectures, documents, and other information, is for your use only and will not be permitted to be re-distributed or re-used.

7. Xu DaRocha Healing Art does not guarantee that you will get any specific results from participating in the Retreat. However, we promise to try our best to do everything to ensure you have the most wonderful experience.

8. You understand that Xu DaRocha Healing Art and Rising Sun Healing Retreat may use photos, audio, or video of you to document, share, and promote Xu DaRocha Healing Art and the Retreat. Please let us know if you do not want us to share any media of you, and we will happily refrain from doing so. Please know that any such sharing will only be used for marketing and promotional purposes.

9. We recommend obtaining “cancel anytime” travel insurance that covers your participation in the retreat's activities. Each client is 100% responsible for any loss, penalties, fees, or other financial consequences arising from booking or canceling a trip.

10. We reserve the right to reject any client booking at any time prior to the start date.

11.  Health, Immunizations, and Travel Warnings: Each guest assumes full responsibility for researching the safety and security of the countries that will be visited. Clients may visit their physician to know what vaccines are recommended. By booking a trip with Xu DaRocha Healing Art, you confirm that you are in good health and capable of performing the activities on the trip you booked. You are also confirming that you are able to care for yourself during the trip and do not have any medical conditions that could cause risk for yourself or others during the trip.

12. Any personal information we collect about you may be used for any purpose associated with operating a trip or to send you marketing material concerning our events and special offers. The information may be disclosed to our agents, service providers, or other suppliers to enable us to operate the trip.

13. Privacy Policy

    You hereby fully indemnify Xu DaRocha Healing Art and any of its members, directors, officers, employees, contractors, volunteers, agents, executors, administrators, successors, family members, and assigns (the “Indemnified Parties”) and save harmless the Indemnified Parties from any losses, claims, damages, actions, causes of action, costs and expenses that an Indemnified Party may sustain, incur or suffer at any time, either during or after the Term, which are based upon, arising out of or occur, directly or indirectly, by reason of any act or omission by you in participating in the Retreat, provided that where Xu DaRocha Healing Art has contributed to such liability by its own negligent conduct, your indemnity obligation will be limited proportionately.

14. General Indemnity

    This Agreement will be governed exclusively by the laws of the State of California. The parties agree to irrevocably submit all claims to the exclusive jurisdiction of the courts of the State of California. Severability. If any provisions of this Agreement are invalid or unenforceable, the other provisions in the Agreement will remain in full force and effect. Entire Agreement. This Agreement constitutes the entire Agreement between the parties and replaces any prior agreements. Waiver of Breach. The waiver by me of any breach by you of any provision of this Agreement will not be taken to be a waiver of any further breaches by you. Notice. For the purpose of this Agreement, e-mail or text will suffice for written notice when required as set out above. Headings. The headings used in this Agreement are for stylistic purposes only, and none of the content in the headings is intended to be legally binding. Counterparts. This agreement may be signed by any number of counterparts, each of which is an original and all of which, taken together, constitute one single document. The effect of this will be the same as if we signed the Agreement by hand, and the intention is that both parties desire to be bound by all the terms of the Agreement.
